The Abuja Division of the Federal High Court has declined to restrain
the Independent National Electoral Commission, INEC, from using the
Smart Card Reader Machines for the presidential election holding
tomorrow.
In a ruling Friday afternoon, Justice Ademola Adeniyi refused to
issue an interim order of injunction stopping INEC from employing the
technology for the presidential poll.
The court however summoned both the electoral body and the Attorney
General of the Federation, Mohammed Bello Adoke, SAN, to appear before
the court on April 24 to address it on the legality or otherwise of the
use of the card readers for a general election.
Meanwhile, even though the court rejected the application which was
filed by a Senatorial candidate of the Peoples Democratic Party, PDP, in
Ogun state, Mr. Walihu Taiwo, it however stressed that if it
eventually ascertains that the use of the card readers were illegal and
unconstitutional, it will not hesitate to annul the outcome of the
general election.
